  Conscription Regulations for Naturalized Aliens & Returning Overseas Chinese

According to Article 20 of the Constitution and Articles 1, 3 and 32 of the Act Of Military Service System, whoever of age 18 and possesses the nationality of Taiwan and has done household registration in Taiwan will start his military service day from January 1st of the proceeding year. Before he is discharged on December 31st of the year at the age of 36, he shall have the duty of serving in military according to the law.

Furthermore, according to Article 2 of the Act Of Conscription Regulations for Naturalized Aliens & Returning Overseas Chinese, "A naturalized male alien within the range of conscription age shall be subject to conscription enlistment according to law upon expiry of one-year period beginning the day next to his initial household registration." And in article 7 of the regulations it states,"The capacity of a returning Overseas Chinese shall be judged on the grounds of conscription-oriented Overseas Chinese certificate issued by the competent authorities in charge of Overseas Chinese affairs or the passport bearing endorsement of Overseas Chinese status." And in article 3.1 of the regulations it states, "A draftee-to-be in the status of an Overseas Chinese having previously established household registration in the Republic of China shall be subject to conscription enlistment according to law upon expiry of one-year period beginning the day next to his return to the Republic of China." And in article 3.2 of the regulations it states, "A draftee-to-be in the status of an Overseas Chinese having not established household registration in the Republic of China previously shall be subject to conscription enlistment according to law upon expiry of one-year period beginning the day next to his initial household registration following his return to the Republic of China." And in article 4 of the regulations it states, "The expiry of one-year period set forth in Paragraphs 1 and 2 of the preceding article shall meet any of the following requirements: 1.Having continually resided for one year in full. 2.Having resided for three times of four months period minimum each in case a draftee-to-be born in the year before 1984. 3.Having resided for up to 183 days minimum in accumulation during the period of January 1~December 31 of every year for two years in case a draftee-to-be born in the year after 1984."

According to Article 16.2 of the Act Of Regulations for Exit of Draftees, "Any draftee who is a naturalized alien, overseas Chinese, or coming from the Mainland China area, Hong Kong, or Macao and not yet required to be subject to the conscription process according to the law applying for exit shall submit support documents to file for the approval with the Entrance & Exit Administration."

According to the aforementioned laws, A naturalized male alien within the range of conscription age, whoever possesses the nationality of R.O.C and has done household registration(get ID card) will have the duty of serving in the military. A Draftee applies for the passport bearing endorsement of Overseas Chinese status (Overseas Compatriot Identity Endorsement), he will have the capacity of a returning Overseas Chinese.

A draftee-to-be in the status of an Overseas Chinese having previously established household registration in the Republic of China shall be subject to conscription enlistment according to law upon expiry of one-year period beginning the day next to his return to the ROC. Applications for an Overseas Compatriot Identity Endorsement within ROC lodged overseas shall be lodged with an Overseas Mission.

Lastly, Any draftee who is a naturalized alien or overseas Chinese, and not yet required to be subject to the conscription process according to the law applying for exit shall submit support documents to file with the approval of National Immigration Agency.
